Baale arraigned over forcible possession of a house

Lagos- A 63 year old Baale Jamiu Jinadu who allegedly took possession of the residence of one Matthew Adeniji‎,yesterday appeared before an Igbosere Magistrate’s Court Lagos.

Jinadu who resides at 10, Orile Ilasan Baale Street, Ilasan Lekki, in Eti-Osa local government area of the state, is facing a one count charge of forceful possession, preferred against him by the police.

The Police Prosecutor Sergeant Oladejo Balogun told the court that the incident took place sometimes in 2016, at the address mentioned above.

He said that the defendant forcibly took over the possession of the complainant’s residence.

“The prosecutor said that the complainant had approached the defendant to give him a land to enable ‎him build a house where he can stay until after the money he spent to build the house expires while he was having accommodation problem.’

“Jinadu agreed and so the complaint built a room self contain with toilet, bath room and kitchen, which he said he spent a total sum of N700,000″‎He said.

“Adeniji, after the completion of the house later changed his mind and gave it out for rent, which he collected a year rent of N150,000, but immediately the rent expired, the defendant went to lock up the place and said he has finished paying the compalint the amount he used to build the house” Balogun stated.

According to the prosecutor the offence committed is punishable under Section 52 of the criminal law of Lagos state 2015.

The defendant however denied the charge.

However the Magistrate Mrs Olabisi Kusanu granted the defendant bail, in the sum of N50,000, with one surety in like sum, who must show evidence of three years tax payment to Lagos State government and have his ‎address verified.

She adjourned the case to August 15, for mention.
